Terms of Service

1. Acceptance of Terms
By accessing or using the Picks4All platform ("the Platform", "the Service", "we", "us"), you agree to be legally bound by these Terms of Service ("Terms"). If you do not agree with any of these terms, you must not use the Service.
These Terms constitute a legally binding agreement between you ("User", "you") and the operators of the Platform.
2. Description of the Service
2.1 Nature of the Service
The Platform is an entertainment service that allows users to:
- Create and participate in "pools" (prediction groups) about sporting events - Make predictions ("picks") about match results - Compete with other users on leaderboards - Manage private groups of friends, family, or communities
2.2 Important Statement: NOT Betting or Gambling
THE PLATFORM IS NOT A BETTING OR GAMBLING SITE.
- No real money is required or accepted to participate in predictions - No monetary prizes are awarded through the Platform - Predictions are purely recreational and for entertainment purposes - The Platform does not facilitate, promote, or associate with gambling activities
Any prizes, rewards, or recognition that pool organizers choose to award are the sole responsibility of said organizers and are conducted outside the scope of the Platform.
3. Eligibility and Registration
3.1 Age Requirements
To use the Platform, you must:
- Be at least 13 years of age - If under 18 years of age, have the consent of your parents or legal guardians
3.2 User Account
By registering, you agree to:
- Provide truthful, current, and complete information - Maintain the confidentiality of your access credentials - Be responsible for all activities conducted with your account - Notify us immediately of any unauthorized use
3.3 One Account per User
Each individual may maintain only one active account. Creating multiple accounts may result in the suspension or termination of all associated accounts.
4. Acceptable Use
4.1 User Conduct
By using the Platform, you agree to:
- Comply with all applicable laws and regulations - Respect other users and maintain a cordial environment - Not use offensive, discriminatory, or threatening language - Not attempt to manipulate, hack, or compromise the security of the Service - Not use bots, automated scripts, or scraping tools - Not impersonate other individuals
4.2 User Content
Usernames, display names, and any content you generate:
- Must not be offensive, discriminatory, or inappropriate - Must not infringe on third-party rights (trademarks, copyrights, etc.) - Must not contain personal information of third parties without their consent
4.3 Prohibited Use
The following is expressly prohibited:
- Using the Platform for illegal activities - Attempting to access other users' accounts - Distributing malware or malicious code - Reverse-engineering the software - Reselling or commercializing access to the Service - Using the Platform to organize real-money betting
5. Pools and Predictions
5.1 Creating Pools
Users may create pools as "Hosts". The Host is responsible for:
- Configuring pool rules (scoring system, deadlines, etc.) - Managing pool membership - Publishing official match results - Maintaining a fair environment for all participants
5.2 Participating in Pools
Participants ("Players") agree to:
- Comply with the specific rules of each pool - Submit their predictions before the established deadlines - Accept the results published by the Host - Respect the decisions of pool administrators
5.3 Deadlines
- Predictions must be submitted before the configured deadline for each match - Once the deadline has passed, predictions cannot be modified - The default deadline is 10 minutes before the match kickoff
5.4 Results and Scoring
- Hosts publish the official results for each match - Scoring is calculated automatically according to configured rules - Error corrections ("errata") are recorded with full traceability
6. Intellectual Property
6.1 Our Property
The Platform, including its code, design, logos, text, and features, is the property of its operators and is protected by intellectual property laws.
6.2 License to Use
We grant you a limited, non-exclusive, non-transferable, and revocable license to use the Platform solely for your personal and non-commercial use, subject to these Terms.
6.3 Third-Party Content
Information about teams, tournaments, and matches may come from third-party sources. The names, logos, and trademarks of teams and competitions belong to their respective owners.
7. Privacy
The use of your personal data is governed by our Privacy Policy, which forms an integral part of these Terms. By accepting these Terms, you also accept our Privacy Policy.
8. Service Availability
8.1 No Guarantee of Availability
The Service is provided "as is" and "as available". We do not guarantee:
- Uninterrupted availability of the Service - The absence of errors or defects - That the Service will meet all your expectations
8.2 Maintenance
We reserve the right to:
- Perform scheduled or emergency maintenance - Modify, suspend, or discontinue features - Update the Service without prior notice
9. Limitation of Liability
9.1 Exclusion of Damages
To the maximum extent permitted by law, we shall not be liable for:
- Indirect, incidental, special, or consequential damages - Loss of data, profits, or opportunities - Service interruptions - Actions of other users - Any activity conducted outside the Platform (including prizes organized by third parties)
9.2 Liability Cap
Our total liability shall not exceed the amount you have paid for the Service in the last 12 months, or $0 if you have made no payments.
10. Indemnification
You agree to indemnify and hold harmless the Platform, its operators, employees, and affiliates from any claim, damage, loss, or expense (including legal fees) arising from:
- Your use of the Service - Your violation of these Terms - Your violation of third-party rights - Content you generate or share
11. Termination
11.1 By the User
You may close your account at any time by contacting us or using the options available on the Platform.
11.2 By Us
We reserve the right to suspend or terminate your account if:
- You violate these Terms - You engage in fraudulent or suspicious activities - You do not use the account for a prolonged period - For any other reason at our discretion
11.3 Effects of Termination
Upon termination:
- You will lose access to your account and associated data - Clauses that by their nature should survive will remain in effect
12. Modifications
12.1 Changes to the Terms
We may modify these Terms at any time. We will notify you of material changes through:
- A notice on the Platform - An email to your registered address - A request for re-acceptance upon login
12.2 Acceptance of Changes
Continued use of the Service after notification constitutes acceptance of the new Terms.
13. General Provisions
13.1 Governing Law
These Terms are governed by the laws of the Republic of Colombia, without prejudice to consumer protection regulations in your jurisdiction that may apply.
13.2 Dispute Resolution
For any dispute related to these Terms or the Service:
1. We will first attempt to resolve it amicably 2. If not possible, the parties agree to submit to the competent courts of Bogota, Colombia
13.3 Severability
If any provision of these Terms is deemed invalid, the remaining provisions shall remain in full force and effect.
13.4 Waiver
The failure to exercise any right under these Terms does not constitute a waiver of that right.
13.5 Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding the use of the Service.
